1. Who we are and this agreement

These Terms are an agreement between you and MapGridder ("MapGridder", "we", "us"), the business that runs mapgridder.com and the pages and tools on it (together, "the Service").

By using the Service you agree to these Terms, the Privacy Policy, and, if you buy Pro, the Refund Policy in section 23. If you use the Service for an organization, you confirm you may accept these Terms for it, and "you" then includes that organization. If you don't agree, please don't use the Service.

2. What MapGridder is for

MapGridder is a browser tool for putting reference grids on maps, measuring, drawing, placing symbols, viewing data layers and exporting maps. People use it to plan hikes and treks, practice land navigation, prepare military exercises, and in real estate, urban planning, environmental work and more.

It is made for peaceful and lawful purposes: planning, navigation, training, education, outdoor recreation, search and rescue, emergency preparedness, and lawful professional work. We may refuse, limit or end service to anyone we reasonably believe uses it otherwise.

3. Plans and licenses

Free (as a guest or signed in). Personal and non-commercial use is free; commercial use needs a paid license. Personal and non-commercial means things like hobby projects, study, training, and your own trips and planning, including exporting and sharing your maps.

Pro is a paid plan for one named person. Besides the features listed on the pricing page, Pro lets that person use MapGridder in their own paid work, for example as a freelancer, consultant or employee. It is personal: one person per subscription, never shared.

Organization license. A business, agency, unit or team needs one when it pays for, directs or rolls out MapGridder for more than one person, and for any on-prem or air-gapped install. Write to sales@mapgridder.com or see the on-prem page.

Government, police and other law-enforcement, military, defense, intelligence, border and private security organizations, and contractors working for them, always count as commercial users, whether or not the use earns money. Each person needs at least their own Pro; use by the organization as a whole needs an Organization license.

Search-and-rescue, emergency-response and other public-safety work is professional use even when it is unpaid or voluntary. A volunteer acting alone needs Pro; a team or organization needs an Organization license.

The limits of each plan (saved maps, zoom, exports, symbols, data layers and so on) are listed on the pricing page and are the limits the Service enforces. We may change them at any time; when a change reduces what a paid plan includes, we email its subscribers before it applies. Working around the limits breaks these Terms.

Map data and other third-party content shown in the Service keeps its own license (section 12).

4. Your account

Signing in is optional and uses an outside sign-in provider, today Google. We may add or change sign-in providers; that alone is not a change to these Terms. One account per person; keep it to yourself. You are responsible for what happens under your account.

You must be at least 16 to use the Service (or older, if your country sets a higher age for consenting to data use), and an adult where you live to buy Pro.

If you think someone else is using your account, tell us at help@mapgridder.com.

5. Pro payments, renewals and cancelling

Our order process is run by our online reseller Paddle.com, which is the Merchant of Record for all our orders. Paddle takes the payment, issues the invoice, charges any sales tax or VAT, and handles billing questions and refund payouts. Paddle's buyer terms apply to the purchase itself.

Pro is billed monthly or yearly in US dollars, plus any tax shown at checkout. It renews automatically at the end of each period until you cancel.

You can cancel anytime from Manage plan in your account menu. You won't be charged again, and Pro stays on until the end of the period you paid for.

If a renewal payment fails and isn't fixed, the account moves to the Free plan.

A price change never touches a period you already paid for. We'll email you at least 30 days before a new price applies to your renewal, so you can cancel first if you want.

Refunds follow our Refund Policy (section 23): a pro-rated refund of the unused time, whenever you ask. Any consumer rights the law where you live gives you apply on top of it.

6. Your maps and content

Your maps, drawings, imported files and exports belong to you. We claim no ownership of them.

Most of what you make stays in your browser. A map reaches our servers only when you save it to your account or share it by link. Images you place as overlays stay on your device.

You give us, and the providers that help us run the Service, permission to store, copy, process and view your saved and shared maps, only to operate, secure, support and improve the Service. We don't sell your maps and we don't publish them.

Anyone who has a share link can view that map until the link expires or you stop sharing. You decide who gets a link, and you are responsible for what the map shows.

You confirm you have the right to use what you import, and that your content doesn't break the law or anyone's rights. We may remove content that does, or that the law requires us to remove.

What we built that appears in your exports (grids, symbols, the look of MapGridder) is licensed to you with your plan: Free exports are for personal and non-commercial use, and Pro exports may be used in your own paid work.

Exports carry credits: our own ("Made with MapGridder") and, wherever map data is shown, the map-data credit (© MapTiler © OpenStreetMap contributors). Keep every credit visible and readable wherever you use, print or publish the export, and don't crop, cover or edit it out.

Some credits may be removed under an Organization license, with our written approval. Credits that the map data's own license requires, such as the OpenStreetMap credit, always stay.

7. When a plan ends

If Pro ends for any reason, the account moves to Free and nothing is deleted. Maps over the Free limits stay in your account and open as usual; you just can't add more than the Free limits allow until you upgrade again.

Your exports stay yours, whatever plan you are on.

8. Keep your own copies, and leaving

We keep saved maps on reliable hosting and take reasonable steps, for a service of our size, to protect them. Even so, saved maps can be lost, for example through an attack, a failure or mistake at one of our providers, or another event outside our control, and we may not be able to restore them. We don't promise backups. Keep your own exports of anything that matters.

To delete your account and everything saved in it, email help@mapgridder.com from the account's address, and we'll delete it within 30 days. You can clear the maps in your browser yourself at any time.

9. Acceptable use

Use the Service lawfully and in good faith. You may not use it to:

• plan, support or carry out terrorism, violent extremism, or any attack on people or property;
• target civilians, or plan anything that breaks the laws of armed conflict;
• stalk, track, harass, threaten or endanger anyone;
• break sanctions, export-control or any other law, or infringe anyone's rights, including privacy and intellectual property;
• scrape, bulk-download or resell map tiles, data or symbols, or reach the Service with bots other than ordinary search engines;
• overload, attack, probe or reverse-engineer the Service, or get around its plan limits, sign-in or security;
• share one Pro subscription among several people; we may end a shared subscription immediately.

You may not use the Service if you are in a country under comprehensive sanctions, or on a government sanctions list.

We may look into suspected misuse, remove content, suspend or close accounts, and cooperate with the authorities when the law requires it or someone's safety is at risk.

10. Safety and accuracy

MapGridder is a planning and reference tool. It is not a certified navigation, dispatch or safety-of-life system, and it is not built or tested for combat, targeting or emergency operations.

Don't rely on MapGridder as your only means of navigation, or as the sole basis for any operational, emergency or safety-of-life decision.

Grids, coordinates, distances, elevations and areas are approximations. Data layers (imagery, public lands, active fires, weather, elevation and similar) come from third parties and may be late, coarse, incomplete or wrong. Search-and-rescue estimates such as search rings and sectors are statistics from published research, not a prediction of where anyone is.

The Service can be slow, offline or unavailable at any moment, including in the field and during an emergency. Always carry an independent way to navigate and communicate, and check critical information against official sources.

Every decision made with MapGridder, and its outcome, belongs to you and your organization, under your own training and procedures.

11. What users do is their own responsibility

We don't review, approve, supervise or take part in any map, plan, mission or operation made with MapGridder. The people who make and use a map are solely responsible for it and for everything done with it.

That includes military, police, security, search-and-rescue, emergency and commercial operations, any harm caused by misuse of the Service, and anything done by people a map was shared with or exported to. We are not responsible for the acts or omissions of any user or third party.

12. Third-party data and services

Basemaps, imagery, place search, elevation, weather, fire and public-land data come from third-party providers under their own terms. The street map is built from OpenStreetMap contributors' data, available under the ODbL license.

You agree to use map content only as its providers' terms allow, including the MapTiler Terms of Service and the OpenStreetMap license. For example, don't pull tiles out of the Service to use elsewhere, and keep the credits (section 6).

We don't control those providers. If one changes its data, raises its price or shuts down, we may change or remove the layer that uses it. If that leaves Pro less useful to you, you can cancel and get the pro-rated refund in section 23.

Links to other sites are there for convenience; we're not responsible for those sites.

13. No warranties

The Service is provided as is and as available, with all its faults. As far as the law allows, we give no warranty of any kind, express or implied, including about accuracy, reliability, availability, fitness for a particular purpose, merchantability or non-infringement.

14. Limits on our liability

As far as the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages; for lost profits, revenue, data, goodwill or missions; or for injury, death or damage to property that arises from using the Service, its maps, exports or data, however caused, even if we were told it could happen.

Our total liability for all claims together is limited to the greater of what you paid us for the Service in the 12 months before the claim arose, or US$50.

Some laws don't allow some of these limits, for example for fraud, for harm caused on purpose or through gross negligence, or for death or personal injury caused by our negligence. Where that is so, these limits apply only as far as that law allows, and your mandatory consumer rights stay in force.

15. If your use causes a claim against us

If anyone makes a claim against us because of your content, your maps or operations, your use of the Service, or your breach of these Terms or the law, you will cover our resulting losses and reasonable costs, including legal fees, as far as the law allows. We'll tell you about the claim, and we may handle our own defense.

16. Disputes

If something goes wrong, write to help@mapgridder.com first. We'll both try in good faith to sort it out within 30 days before either side takes it further.

These Terms are governed by the laws of the State of Israel, and disputes go to the competent courts of the Tel Aviv District. If you are a consumer, you keep any mandatory protection the law where you live gives you, including the right to use your local courts where that law grants it.

As far as the law allows, a claim must be brought within one year after it arose, and only on your own behalf, not as part of a class or representative action.

17. Suspension and ending

You can stop using the Service at any time, and delete your account as described in section 8.

We may suspend or close an account, or block access, when it breaks these Terms, puts people or the Service at risk, involves fraud or chargeback abuse, or when the law requires. Where it is reasonable and safe, we'll tell you why and give you a chance to export your maps first.

If we close a paid account when you did nothing wrong, we refund the unused part of the paid period. We may also end any account for another reason; for a paid one, we refund the time left. If we close an account because it broke these Terms, we don't refund the time left.

If we decide to shut the Service down, we'll tell paid users ahead of time, leave time to export their maps, and refund the paid time that remains.

18. Changes to the Service and these Terms

We may change, add or remove features. We may update these Terms, and the date at the top always shows the latest version. For a material change, we'll show a notice in the app before it applies.

If a change reduces what a paid plan includes, we email its subscribers before it applies, and you can cancel and get the pro-rated refund for the time left. If you don't accept a change, stop using the Service and cancel. If you keep using it, you accept the change.

19. Ownership

MapGridder, including its code, design, features, text, graphics, symbols, data and domains, belongs to its owner and is protected by copyright and other intellectual-property laws. You get a limited, personal, revocable, non-exclusive, non-transferable right to use it under your plan. Paying for Pro buys that right, not any share of the Service.

Don't copy, modify, reverse-engineer, scrape, resell or build derivative works from the Service.

If you send us feedback, suggestions or ideas, we may use them freely, without payment or credit.

20. Privacy

Our Privacy Policy explains what we collect and how you control it. Where the law requires, analytics cookies stay off until you accept them.

We don't show ads today. We may add advertising in the future; if we do, we'll update these Terms and the Privacy Policy before it starts.

21. Trademarks

All third-party product names, logos, and brands mentioned on this site are the property of their respective owners. References to them are descriptive only and do not imply any affiliation, sponsorship, or endorsement.

22. General

These Terms (the Refund Policy included) and the Privacy Policy are the whole agreement between us about the Service. Our reseller's order terms apply to the purchase itself.

If part of these Terms can't be enforced, the rest still applies. If we don't enforce a right now, we haven't given it up.

We may transfer these Terms to a company that takes over the Service, for example one we set up to run it. You may not transfer them without our written consent.

We're not responsible for delays or failures caused by events outside our reasonable control, such as outages at hosting or data providers, war or natural disasters.

We may send notices by email or in the app. If you read these Terms in a translation, the English version is the one that counts.
